The fine print

These terms apply when you use resurf.nz and the Resurf app. By joining or using Resurf you agree to them, along with our community rules and privacy policy.

What Resurf is

Resurf is a place for people in New Zealand to buy and sell second-hand surf gear and find people to surf with. We're not the buyer or seller. Every sale is a deal between the buyer and the seller. We don't own, inspect or hold the gear, and we don't handle payments between members.

Your account

• You need to be 16 or older to join, and 18 or older to use Surf Buddies.
• Use your real first name and keep your contact details up to date. One account per person.
• You're responsible for what happens on your account, so keep your email and phone secure.

Fees

Listing and selling on Resurf is free. There are no listing fees, seller fees or success fees. If we ever add paid extras (like boosting a listing), they'll be optional and we'll show the price before you pay.

Listing gear

• Only list surf gear that you own and have the right to sell. No stolen, counterfeit or recalled items.
• Describe it honestly: the condition rating, dims, dings, repairs and photos must be accurate and of the actual item.
• "Fill it in from my photos" uses AI to suggest details. Suggestions can be wrong, so check everything. You're responsible for what your listing says.
• Mark your listing as sold, or delete it, once it's gone.
• By posting photos and text, you let Resurf show them on the site, in the app, and in posts promoting your listing or Resurf. You keep ownership, and this permission ends when you delete them (except where already shared).

Buying and selling

• Agree the price, payment, pickup or shipping directly with the other person.
• Check the gear in person before you pay where you can. Don't pay deposits to people you haven't met.
• Private sellers: the Consumer Guarantees Act and Fair Trading Act generally don't apply to private sales, but misleading someone is still not OK, and is against these terms. If you sell in trade (as a business), those laws apply to you and you must say you're a business in your listing.
• Shipping costs and estimates on Resurf are a guide only. The seller sets the final shipping price.
• Use the safety guide for meeting up and posting gear.

Messages and Surf Buddies

Keep messages respectful and about surfing or the gear. Don't send spam, scams, abuse or anyone's private details. Meeting anyone you find on Resurf is at your own risk. See the community rules.

What we can do

We can remove listings, posts or messages, and suspend or close accounts, if we believe someone has broken these terms or the community rules, or to keep members safe. We can change or stop parts of Resurf at any time.

Liability

Resurf is provided "as is". We do our best to keep it running and safe, but we don't guarantee that listings are accurate, that members are who they say they are, or that the site will always be available. To the extent the law allows, Resurf isn't liable for any loss or damage arising from deals, meetings or contact between members, or from using the site. If we are found liable, our total liability is limited to NZ$100. Nothing in these terms limits any rights you have under New Zealand law that can't be excluded, including under the Consumer Guarantees Act where it applies.

Changes and contact

We may update these terms. If the changes are important, we'll let members know and update the date at the top. These terms are governed by New Zealand law. Questions or problems? Email hello@resurf.nz.
